【摘要】解农村民事纠纷解决机制的现状就有一定的社会现实意义。本文以一客家族聚集县为考察对象,以调查实践和法律文本分析为方法,力图揭示村民间民事纠纷解决机制的现状和特点。本文正文分为四部分:第一部分为导论部分。此部分的写作目的主要是为了说明在农村,维持社会秩序、调解民事纠纷的社会规范不单单是国家法律,而是一种国家法律和由社会风俗、习惯等组成的民间社会规范共同影响的局面。首先笔者在简要叙述了民事纠纷解决机制概念、其解决纠纷恢复社会秩序的功能后,对我国学界公认的四种民事纠纷解决方式作了一个简评。随后,笔者对我国农村社会的民间社会规范进行了分析,重点论述了民间规范在农村社会发达的原因及其特点。第二部分:客家地区村民之间的民事纠纷解决机制的实证分析。本部分是对笔者实地走访调查结论的一个分析总结。......
